What is an Affidavit of Execution?

An affidavit of execution is a sworn statement by a witness confirming that they were present when a document was signed and that the signature is genuine. It is commonly attached to wills, powers of attorney, and other important legal documents to confirm the signing was properly witnessed.

When Would You Use This?

  • Attached to a will to confirm the testator signed in the presence of witnesses
  • Required by a financial institution or government agency to validate a signed document
  • Used alongside a power of attorney to confirm proper execution
  • Required by a court or estate trustee when probating a will
