What is a Certificate of Acknowledgment for a Separation Agreement?
A certificate of acknowledgment is a document signed by a lawyer confirming that a party to a separation agreement received independent legal advice before signing. In many provinces, a separation agreement is not enforceable unless both parties have received independent legal advice and obtained this certificate.
When Would You Use This?
- After negotiating a separation agreement and before or at the time of signing
- Required by your province to make the separation agreement enforceable
- When a court or government agency requires proof of independent legal advice
- As part of a complete separation or divorce package

Click the button below to open a copy in Google Docs. Fill in your personal details and the relevant facts. Once complete, print and sign it in the presence of a notary public — do not sign beforehand. A commissioner of oaths may be used instead of a notary public for some documents, but not all. A notary public can sign all documents.
