A roommate agreement is a practical contract between two or more people sharing a rental property. Unlike a lease, which governs the relationship between tenants and the landlord, a roommate agreement governs the relationship among the tenants themselves — addressing how they will share costs, responsibilities, and the living space.
What it covers
A well-drafted roommate agreement addresses: how rent and utilities will be split; which roommate's name is on the lease; how household supplies and shared groceries will be handled; cleaning duties; guest policies; quiet hours; rules about common areas; how disputes will be resolved; and the process for a roommate leaving or being replaced.
Legal status
A roommate agreement is a private contract between the parties and is generally enforceable as such. However, it does not change the legal relationship between any roommate and the landlord — the person named on the lease remains responsible to the landlord for full rent payment regardless of the roommate agreement.
