A sole proprietorship declaration — also called a business name declaration or trade name declaration — is a statutory declaration in which an individual confirms that they are carrying on business under a registered trade name as a sole proprietor. It is used to establish or verify the connection between the individual and the business name for banking, contract, and regulatory purposes.

When it is required

Banks frequently require a sole proprietorship declaration or a copy of the business name registration before opening a business account in the trade name. Government agencies, suppliers, and contracting parties may also require it to confirm the legal identity behind a business name.

Relationship to business name registration

A sole proprietorship declaration is not a substitute for registering your business name with the provincial registry — that is a separate requirement in most provinces. However, once you have registered your business name, a statutory declaration confirming the registration is a widely accepted document for establishing your authority to act on behalf of that business.
